This Privacy Policy explains how LandMonkey ("we," "us," or "our") collects, uses, shares, and protects personal information when you use our website at landmonkey.com (the "Site"), purchase land from us, finance a purchase through us, sign up for property alerts, or otherwise interact with our services.
Please read this policy carefully before using the Site or submitting any personal information. By using the Site, you accept the practices described here. We may update this policy from time to time; changes will be posted with a new "Last Updated" date and apply only on a going-forward basis. Material changes will be highlighted at the top of this page when made.
This policy applies to LandMonkey.com only. The Site may contain links to third-party websites whose privacy practices we do not control and do not endorse. Please review their privacy policies separately.
2. Scope
This policy applies to:
Visitors to the Site
Customers who purchase or finance land through us
Account holders
Email subscribers (including land alert subscribers and newsletter recipients)
People who submit inquiries, reviews, or referrals
Recipients of referral invitations through our invite program
If you are a California resident, you have additional rights described in Section 8 (Your California Privacy Rights) below.
We do not knowingly collect personal information from anyone under the age of 16. See Section 11 (Children's Privacy).
3. Information We Collect
3a. Information You Provide Directly
When you interact with our Site, you may provide us with:
Account creation: name, email address, password (which we store only in hashed form)
Land purchase and financing: legal name, phone number, billing address, mailing address
Payment details: credit card information, which is tokenized through our payment processor (Authorize.net). We do not store full credit card numbers on our servers.
Identity verification for financing: We do not currently collect Social Security numbers, dates of birth, or government identification documents through our online financing flow.
Customer support and contact submissions: name, email address, optional phone number, and the content of your message
Land alert signups: email address and optional preferences (such as state or property type)
Property inquiries: name, email address, and the content of your question
Reviews: name and review content
Referral / invite program: the names and email addresses of people you invite, and your name as the referrer
Cancellation feedback: any free-form reasons you provide when canceling an account or service
3b. Information Collected Automatically
When you use the Site, we and our service providers automatically collect:
IP address and approximate geolocation derived from your IP (typically city, region, and country level)
Browser type, operating system, device type, and language settings
Pages viewed, time on page, referring URL, and UTM parameters
Click and interaction events such as form submissions and button clicks
Session recordings via Microsoft Clarity: Clarity records your interactions with our Site, including mouse movements, scroll behavior, click coordinates, and snapshots of the pages you view. This is more detailed than typical website analytics. Sensitive form fields are masked, but you should be aware that this recording is taking place.

Process orders, payments, contracts, and ongoing financing balances
Send transactional emails such as order confirmations, payment receipts, and account notifications
Send marketing emails, including land alerts and newsletters, when you have subscribed (delivered through Klaviyo)
Personalize and improve the Site using analytics
Detect, investigate, and prevent fraud and abuse
Comply with legal obligations
Generate inferences about your interests (for example, the types of properties or markets you appear to be interested in)
6. Cookies and Tracking Technologies
We and our service providers use cookies and similar tracking technologies to operate the Site, secure transactions, analyze usage, and deliver advertising.

In addition to cookies, we use pixel-based tracking technologies (browser-side scripts that send data to third parties without setting cookies — including Meta Pixel, Microsoft Clarity, and Google Analytics 4) and server-side tracking (we send certain conversion events directly to advertising partners from our servers — see Section 7).
You can control cookies through your browser settings, though disabling certain cookies may affect Site functionality. California residents can opt out of "sale" and "sharing" of personal information through the methods described in Section 8.
7. How We Share Information
7a. Service Providers
We share personal information with service providers who help us operate the Site and our business. These providers are contractually limited to using the information only to perform services for us. They include:
Authorize.net — payment processing
Postmark and/or AWS SES — transactional email delivery
Cloudflare — security, bot protection (including Turnstile challenges), and DDoS protection
DigitalOcean Spaces — image and asset hosting
Stape — server-side relay for Meta Conversions API
DigitalOcean — application hosting infrastructure
Slack — internal administrative notifications
7b. Advertising and Analytics Partners
We share certain personal information with advertising and analytics partners for cross-context behavioral advertising, attribution, and analytics. Under California law, this sharing constitutes a "sale" or "sharing" of personal information, which you can opt out of (see Section 8). These partners include:
Google (Google Analytics 4) — page views, events, approximate geolocation, and device information. We send events client-side via the gtag library and pull aggregate reporting data via the GA4 Data API. Categories shared: identifiers, internet/network activity, geolocation. Purpose: analytics and ad measurement.
Meta Platforms (Facebook Pixel and Conversions API) — page views, content views, leads, checkout events, and purchases. For server-side events including a "FirstPaymentReceived" event when a financed account makes its first non-downpayment payment, we share hashed name, email, phone, city, state, ZIP code, transaction value, and order/account identifiers. Categories shared: identifiers, internet/network activity, commercial information. Purpose: advertising attribution and audience targeting.
Microsoft (Clarity) — full session recordings, click and scroll heatmaps. For logged-in users, sessions are identified using your account ID and first name. Categories shared: identifiers, internet/network activity. Purpose: site experience analysis.
Klaviyo — email address, first name, phone number, and product view, add-to-cart, checkout, and purchase events for users on our marketing list. Categories shared: identifiers, commercial information. Purpose: email marketing identification and segmentation.
7c. Legal and Safety Disclosures
We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when:
Permitted or required by law;
We are trying to protect against or prevent actual or potential fraud or unauthorized transactions; or
We are investigating fraud that has already occurred.
We do not provide your information to these companies for marketing purposes.
7d. Business Transfers
If we are involved in a merger, acquisition, financing, sale of assets, or bankruptcy, your personal information may be transferred to the successor or acquiring entity as part of that transaction. We will notify you of any such transfer in accordance with applicable law.
8. Your California Privacy Rights (CCPA / CPRA)
This section provides additional disclosures required by the California Consumer Privacy Act ("CCPA"), as amended by the California Privacy Rights Act ("CPRA").

8b. Categories Sold or Shared in the Past 12 Months
We have "sold" or "shared" (as those terms are defined under California law) the following categories of personal information for cross-context behavioral advertising and analytics purposes:

These categories have been shared with Google, Meta, Microsoft, and Klaviyo for the purposes described in Section 7b.
We have not sold or shared the personal information of any consumer we have actual knowledge is under 16 years of age.
8c. Categories Disclosed for a Business Purpose
We have disclosed the same categories listed in 8a to the service providers listed in Section 7a for the business purposes described there.

8e. Your Rights
If you are a California resident, you have the following rights, subject to certain exceptions and verification requirements:
Right to know what personal information we have collected, used, disclosed, sold, or shared
Right to delete personal information we have collected from you
Right to correct inaccurate personal information we maintain about you
Right to opt out of the sale or sharing of your personal information
Right to limit the use and disclosure of Sensitive Personal Information (if applicable based on Section 8a)
Right to non-discrimination for exercising your privacy rights
8f. How to Exercise Your Rights
To opt out of sale or sharing: click the "Do Not Sell or Share My Personal Information" link in the footer of our Site, which will take you to our preference page at /your-privacy-choices.
Global Privacy Control: We honor the Global Privacy Control (GPC) browser signal as an automatic opt-out from sale and sharing. If your browser sends a GPC signal, we will treat it as an opt-out for that browser without requiring further action from you.
To exercise other rights (right to know, delete, correct, or limit use of Sensitive PI), email us at [email protected] with the subject line "Privacy Request." We will need to verify your identity before processing your request, typically by confirming information that matches what we already have on file. We will respond within 45 days, with a possible 45-day extension if needed (a total of up to 90 days) as permitted by law.
Authorized agents: You may designate an authorized agent to make a request on your behalf. The agent must provide written authorization signed by you, and we may require you to verify your own identity directly with us before responding to the agent's request.
8g. Notice of Financial Incentive
We may offer financial incentives such as our referral program, which provides credits to participants who invite others to our service. Participation is voluntary and you may withdraw at any time by not submitting referrals. We do not consider the value of the personal information collected to materially exceed the value of the incentive offered.
9. Data Retention
We retain personal information only as long as needed to fulfill the purposes for which it was collected, comply with our legal obligations, resolve disputes, and enforce our agreements. Specifically:
Account data: retained while your account is active and for a reasonable period after closure to comply with tax, accounting, and legal obligations
Transaction records and financing contracts: retained for at least 7 years to comply with tax and financial recordkeeping requirements
Marketing email lists: retained until you unsubscribe or after a period of inactivity
Server logs: retained for a reasonable period of time
Session recordings (Microsoft Clarity): retained according to Microsoft Clarity's default retention period
Google Analytics data: retained for 14 months or a reasonable period of time
Customer support records: retained for the duration of our customer relationship plus a reasonable period thereafter for reference and dispute resolution
When personal information is no longer needed, we delete or anonymize it.
10. Data Security
We take reasonable and appropriate measures to protect personal information from unauthorized access, disclosure, alteration, and destruction. These measures include:
Encryption of data in transit using HTTPS/TLS
Hashed storage of account passwords (we never store passwords in plain text)
Tokenization of payment card data through our payment processor — we do not store full credit card numbers
Access controls that limit personal information to authorized personnel only
Application-level security headers and protections against common web vulnerabilities
No method of transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you and applicable regulators in accordance with law.
11. Children's Privacy
The Site is not directed to children under the age of 18. We do not knowingly collect personal information from anyone under 18, and we do not knowingly sell or share the personal information of anyone we have actual knowledge is under 18.
If you believe a child under 18 has provided us with personal information, please contact us at [email protected] and we will take steps to delete that information.
12. International and Out-of-State Users
LandMonkey.com is operated from the United States and is intended for use by U.S. residents. If you access the Site from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States. By using the Site, you consent to this transfer and processing.
13. Changes to This Policy
We reserve the right to update this Privacy Policy from time to time. When we make material changes, we will:
Update the "Last Updated" date at the top of this page
Highlight the changes prominently at the top of the policy when reasonable
For significant changes, notify registered users by email when feasible
Continued use of the Site after changes are posted constitutes your acceptance of the updated policy.
